OUR DOCUMENTS
Merchant terms
Version 2026-10-05 — effective 5 October 2026. A professional legal review is planned; any changes will be published as a new version, with notice as described under "Changes to these terms".
These terms are between Ted Cane trading as Momentburst, a sole trader based in London, United Kingdom ("Momentburst", "we", "us"), and the business that installs the Momentburst: Football Sales app on its Shopify store ("you"). Contact and support: support@momentburst.com. We are contactable by email only, and notices are given by email as described under "Notices".
Agreement
You accept these terms and the data processing agreement (DPA), and confirm that you have read the privacy policy, by ticking the acceptance checkbox in the app. Any staff member with access to the app may accept; by accepting, they confirm that they are authorised to accept on behalf of the business that operates the store. We record the store, the document versions, the time of acceptance and the accepting staff member's Shopify user ID. Rules cannot be activated and moments do not run until the current versions have been accepted. The app is for businesses only, not consumers. Shopify's own terms, including the Shopify Partner Program and app billing rules, also apply to your use of Shopify and are not changed by these terms.
The service
Momentburst watches supported football fixtures (currently Premier League clubs and England). When your chosen team scores, wins or keeps a clean sheet, and your rule allows it, the app creates a timed automatic discount in your Shopify store, shows a countdown banner on your storefront through the app's theme extension, can send a Shopify Flow trigger, and, on plans that include email, can send a campaign from your own Klaviyo account to the audience you choose. It then shows which orders used each moment's discount.
Guardrails. To reduce wrong or excessive promotions, the app:
waits 90 seconds after a goal is reported before firing, to allow for VAR and data corrections, and 120 seconds after full time;
skips a goal confirmed more than 10 minutes after it was first reported, and pauses while live data is delayed;
runs one moment at a time per store, with at least 15 minutes between moments;
limits each rule to 1–3 moments per match and your store to a daily moment cap (default 4, maximum 6) and a daily email cap (default 2, maximum 3);
sends moment emails only between 08:00 and 22:00 UK time and only if they can be sent within 5 minutes of the moment starting;
keeps discount windows between 5 and 60 minutes and percentage rewards between 5% and 50%.
We may change guardrails to protect stores, shoppers or the service, and will not loosen them without notice.
Overturned goals. If a goal is overturned after a moment has started, the discount stays valid until its original end time, the banner changes to an overturn message, and emails and Flow triggers that have not started are cancelled.
No guarantees about matches, timing or sales
Live sports data comes from a third-party provider and can be late, wrong, corrected or unavailable. A moment may start late, start after a correction, or not start at all. We do not guarantee any particular speed, that every qualifying event will trigger a moment, uninterrupted availability, email delivery or inbox placement, or any increase in sales. Results and baseline comparisons are estimates; they do not prove that a moment caused a purchase.
Plans and billing
Billing is handled by Shopify through Shopify App Pricing. Plans are priced in US dollars and charged every 30 days:
| Plan | Price per 30 days | Teams | Active rules | Email moments | Results history shown |
|---|---|---|---|---|---|
| Starter | $24 | 1 | 2 | No | 30 days |
| Pro | $59 | 3 | 10 | Yes | 12 months |
| Club | $119 | Unlimited | Unlimited | Yes | Unlimited |
| Founding Pro | $35 | 3 | 10 | Yes | 12 months |
Shopify charges in US dollars and converts the charge to your billing currency where that differs; Shopify sets the conversion. Applicable taxes are shown by Shopify. You choose, change and cancel plans on Shopify's plan page, and Shopify's plan page governs the amount, currency and billing interval you approve. We never see your card or bank details.
There is no free trial on any plan. You can see the app working on your own store before you pay: a store without a plan can choose one team, save rules (paused) and run up to 3 test moments. Only completed test moments count, and reinstalling does not reset the count. A test moment creates a real automatic discount in your store for 5 minutes, which any shopper who checks out during that time can receive; its banner is shown only in your theme preview, and it never sends email. Real moments and active rules need a paid plan.
If you downgrade, the app keeps your oldest teams and rules within the new plan's limits, pauses the rest and turns off email where the plan does not include it. If you cancel, uninstall or Shopify reports that your plan is inactive, the app stops new moments; discounts already running keep their original end time.
Billing is handled by Shopify. Fees are not refunded for partial billing periods, including when you cancel, downgrade or uninstall during a period, except where the law requires a refund. We may change prices for future billing periods with at least 30 days' notice; a price change needs your approval in Shopify where Shopify requires it.
Founding Pro offer
Founding stores get Pro for $35 a month, locked in for life. Normally $59. Limited to the first 50 UK stores.
Founding Pro is a private plan, offered by invitation only to stores we confirm are based in the UK. We invite a store by giving it access to the plan in Shopify; the merchant then approves the subscription in Shopify. A request through our website does not reserve a place. The first 50 stores to activate Founding Pro use the 50 places permanently; a place is not reopened when a store leaves, and a pricing or currency change does not reset the count.
"For life" means for as long as the invited store keeps the same Founding Pro subscription without a break. Cancelling, uninstalling or switching to another plan ends the founding price permanently; a later subscription is at the normal price then offered (currently $59 for Pro). If Shopify freezes the subscription for non-payment and it later resumes unchanged, the founding price continues, but paid features are paused while it is frozen. "A month" means a 30-day billing period. The price lock covers the base plan price only, not taxes, currency conversion or future optional add-ons, and it is not a promise that the service will continue indefinitely. The offer is attached to the invited store and cannot be transferred.
Your responsibilities
You must control the Shopify store and any Klaviyo account you connect, keep your credentials secure, and give accurate information. You are responsible for your rules, discounts, banner text, email content, audiences and sender settings, and for checking that every promotion is lawful, accurate and suitable for your store, stock and customers. You remain responsible for fulfilment, customer service and honouring offers that the app has created.
You must have a lawful basis and any consent your marketing needs, a privacy notice to your customers that covers this processing, and a properly authenticated sender for email. Klaviyo applies its own subscription, suppression and unsubscribe handling.
No alcohol promotions. UK rules prohibit drinks promotions linked to the result of a sporting event. You must confirm in the app that the products your moments discount do not include alcohol, and you must not use the app to promote alcohol. The app blocks collections it detects as alcohol, but that check does not replace your own review.
Acceptable use. You must not use the app for unlawful, misleading or harmful promotions, for gambling or betting promotions, to discriminate against shoppers, to interfere with the app, Shopify or our providers, or to get around plan limits or guardrails.
Clubs, leagues and intellectual property
Momentburst is not affiliated with any club, league or governing body. The app uses team names only as plain facts and uses original colour styles, not club crests, badges, replica kits, official club fonts, mascots, nicknames or slogans. You must not add such material, or any other content you do not have the right to use, to your banners, discount titles, emails or storefront through the app. You confirm that you own or are licensed to use all text, images and other content you supply ("your content"), and that it does not infringe anyone's rights. If the app lets you add images, you must confirm your rights for each image before it is shown.
You keep ownership of your content. You give us a non-exclusive licence to use it only to provide the service to you. We and our licensors own the app, its designs, code and documentation. You may give us feedback, and we may use it without obligation to you.
Data protection and security
The privacy policy explains how we handle personal data, and the DPA governs our processing of your customers' data on your behalf. We maintain the security measures described in the DPA.
Support
Support is by email to support@momentburst.com. We aim to reply within 2 business days (UK).
Suspension and termination
You can stop using the app at any time by uninstalling it. Uninstalling removes our access to your store immediately; discounts already created keep their original end time because we can no longer delete them, and Shopify asks us to delete your remaining data 48 hours later, as the DPA describes. We keep only a minimal record of your agreement acceptance, as the privacy policy describes.
We may suspend the app for your store immediately if needed to prevent harm to shoppers, your store, Shopify, our providers or the service, including a suspected security incident, a breach of these terms, or a provider withdrawing match data. We will tell you why as soon as we reasonably can. We may end these terms for a serious or persistent breach that you do not fix within 14 days of notice, or for any reason on 30 days' notice. If we end them without cause, we will refund any fees you have prepaid for the period after the end date.
Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or any other liability that cannot be limited by law.
Subject to that, neither party is liable for loss of profits, sales, revenue, business, goodwill or anticipated savings, or for any indirect or consequential loss. You are responsible for the cost of discounts your rules create, including test-moment discounts. Each party's total liability arising out of or in connection with these terms in any 12-month period is limited to the fees you paid for the app in the 12 months before the event giving rise to the claim. You are responsible for claims by your customers or others arising from your promotions, your content or your breach of these terms.
The app is provided with reasonable care and skill. Except as stated in these terms, no other warranties apply to the extent the law allows.
Changes to these terms
We may update these terms, the DPA and the privacy policy. Each update is published as a new version with a new effective date. We will give at least 30 days' notice of a material change by email to your store's contact email address, and also show it in the app, unless the change is needed sooner for legal or security reasons; we will ask you to accept the new version in the app; once a new version takes effect, rule activation and new moments pause until it is accepted. If you do not accept, you can uninstall before the change takes effect.
Notices
Notices under these terms and the DPA are given by email. Notices to us must be sent to support@momentburst.com. We send notices to you at your store's contact email address in Shopify, so please keep it up to date; notice of changes is also shown in the app, as described under "Changes to these terms", but the emailed notice is the one that counts.
An emailed notice is treated as received when it is sent, unless the sender receives a message saying that it was not delivered. In that case the notice has not been given, and the sender should check the email address and send it again.
General
These terms and the DPA are the whole agreement about the app; the privacy policy explains how we handle personal data. Neither party is liable for delay caused by events outside its reasonable control. You may not transfer these terms without our consent; we may transfer them to a business that takes over the app on notice to you. If a provision is unenforceable, the rest remains in effect. No one else has rights under these terms. These terms and any dispute about them are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
